Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and The Novita Group Pty Ltd ("Company," "we," "us," or "our") concerning your access to and use of our website and services.
By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.
Services
Novita Group provides professional audio and video production services, including but not limited to:
- Voice over recordings (male and female)
- Audio production and editing
- Video production and editing
- Script writing and development
- Animation and explainer videos
- Commercial and promotional content
Orders and Payment
Placing Orders
When you place an order for our services, you agree to provide accurate and complete information. All orders are subject to acceptance and availability.
Pricing
All prices are quoted in Australian Dollars (AUD) unless otherwise specified. We reserve the right to change our prices at any time, but changes will not affect orders already confirmed.
Payment Terms
- Payment is required before production begins unless otherwise agreed in writing
- We accept major credit cards and bank transfers
- For larger projects, a deposit may be required with the balance due upon completion
Delivery and Revisions
Delivery Times
Standard delivery is within 5 business days from order confirmation and receipt of all required materials. Rush delivery may be available for an additional fee.
Revisions
Each package includes a specified number of revisions. Additional revisions beyond the included amount will be charged at our standard hourly rate.
Client Materials
You are responsible for providing all necessary materials (scripts, images, logos, etc.) in a timely manner. Delays in providing materials may affect delivery times.
Intellectual Property
Client Content
You retain ownership of any content you provide to us. By providing content, you grant us a license to use it solely for the purpose of delivering our services to you.
Final Deliverables
Upon full payment, you will own the rights to the final deliverables we create for you, except for:
- Third-party elements (stock footage, music, fonts) which are licensed, not owned
- Our underlying tools, templates, and methodologies
Portfolio Rights
We reserve the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.
Client Responsibilities
You agree to:
- Provide accurate information and materials
- Respond to requests for feedback in a timely manner
- Ensure you have the rights to any materials you provide
- Not use our services for any unlawful purpose
- Not request content that is defamatory, obscene, or infringes on third-party rights
Cancellation and Refunds
Cancellation by Client
- Orders cancelled before production begins: Full refund minus any administrative fees
- Orders cancelled during production: Partial refund based on work completed
- Orders cancelled after delivery: No refund
Cancellation by Us
We reserve the right to cancel any order if:
- The requested content violates our policies or applicable laws
- Payment cannot be processed
- We are unable to complete the work due to circumstances beyond our control
Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the amount you paid for the specific service in question
- We are not liable for any indirect, incidental, or consequential damages
- We are not liable for any loss of profits, data, or business opportunities
Warranty Disclaimer
Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our services will meet your specific requirements or achieve particular results.
Indemnification
You agree to indemnify and hold harmless Novita Group and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
- Content you provide to us
Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the new Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
